The West Virginia Medical Cannabis Act provides a drug approval process for using medical marijuana as a treatment for various conditions and symptoms.

If a patient meets all the requirements imposed by the state, they can become registered patients and receive their medical marijuana card. What follows are the qualification criteria for becoming a certified medical marijuana patient in West Virginia.

What Are the Marijuana Laws in West Virginia?

West Virginia's medical marijuana laws are similar to other states, except that West Virginia stands out as having one of the strictest policies in the country when determining whether a patient has a debilitating medical condition.

West Virginia only allows for the possession of cannabis by legally registered patients and their caregivers. While West Virginia registered patients can purchase medical marijuana from licensed dispensaries across the state, home cultivation is prohibited. Patients can only purchase a maximum of a 30-day supply.

1. Have a Qualifying Medical Condition

To get a medical marijuana West Virginia card, you must first book a consultation with a state-licensed physician. They are the only ones who can determine whether or not your condition qualifies for the treatment.

The qualifying medical conditions to use medical marijuana in West Virginia include but are not limited to:

  • Cancer
  • Epilepsy
  • Multiple sclerosis
  • Post-traumatic stress disorder
  • Chronic pain
  • Parkinson's disease

Nevertheless, a doctor can determine your condition as quantifiable even if doesn’t show on the list. If they believe that your symptoms will benefit from undergoing the treatment, they may still recommend you for becoming a registered patient.

2. Be a Resident of West Virginia

To apply for a medical marijuana card in West Virginia, you must be a resident. Medical marijuana patients will only be able to legally purchase products from licensed dispensaries within the state.

Medical marijuana cards only work on a reciprocity basis in a few states. Your West Virginia medical marijuana card will only cover you legally within the state. Nevertheless, terminally ill cancer patients can be allowed to buy medical cannabis in other states, as a result of the agreement between the bureau and the other state.

3. Be 21 Years of Age or Older

Patients under the age of 21 can also apply for a medical marijuana card, however, they must have a parent or legal guardian as a registered member of the medical marijuana program.

Caregivers must be 21 or older and also be registered to purchase medical marijuana in the state. A patient can have a maximum of two caregivers.

4. No Drug-Related Offense in Any Jurisdiction

Convicted applicants may apply for a medical marijuana card after five years after being released, pardoned, or expunged.

5. Get a Written Recommendation From a State-Licensed Physician

Doctors can recommend medical marijuana as an alternative treatment to opioids, non-opioid medications, physical therapy, and many others.

Doctors must also meet specific requirements. They must have a license and a certificate from the West Virginia Board of Medicine to prove that they are legally certified to recommend medical marijuana to their patient.

To get a written recommendation, all you have to do is book a consultation with a licensed physician and check if your condition qualifies for the medical marijuana card in West Virginia.

6. Have Your Documents Ready

When applying for a medical marijuana card in West Virginia, you will need to present the following documents:

  • ID
  • Proof of residency
  • A signed medical cannabis certificate

Only with a medical cannabis certificate, you can be fully registered as a medical marijuana patient.
